Abstract:The deductive works of folk literature and art have dual characteristics of both folklore and deductive works, thus causing the dilemma in copyright protection. The way to get out of this dilemma is to start from a typological perspective, divide folklore deduction works into original ecological deduction works and regenerative deduction works, and match them with corresponding originality standards. At the same time, when the use of derivative works requires the permission of the copyright owners of the original work, a dual-track system model should be implemented, that is, a specific ethnic organization is an authorized representative for those involving ethnic culture, and a specialized agency is the representative for the rest. Finally, it is proposed that the benefit sharing of folklore deductive works should put their continuous development as the priority, and should not be completely guided by the market-oriented approach. By building a reasonable copyright protection system, we hope to promote the innovative inheritance and development of folklore and art.
