Abstract:In recent years, operators who harm consumers'' right to fair trade and independent choice in e-commerce platform shopping have increasingly "cut orders", and the two parties are constantly in conflict. The fundamental reason for the increasing "order cutting" behavior is the inconsistency of the judgment standards of invitation to offer, offer and acceptance, as well as the abuse of standard terms by operators. Therefore, it is necessary to regulate the behavior of "cutting orders". First of all, we should pay attention to the norms in advance, that is, to unify the judgment standards of invitation to offer, offer and acceptance. Secondly, it is necessary to regulate the use of standard terms by e-commerce operators, that is, the standard terms that are invalid and controversial in violation of mandatory provisions of the law cannot be formulated by e-commerce platforms alone. Finally, after the "order cutting" behavior occurs, we should not only regulate the responsibility of operators to consumers, but also regulate the responsibility of e-commerce platforms and operators, so as to safeguard the legitimate rights and interests of consumers.
