Abstract:At present, the practical teaching of mock trial in the higher education of law major has excessive performance and insufficient simulation, which is not good for the cultivation of comprehensive practical ability and independent thinking or deciding ability for students, and meanwhile, which also makes the responsibility scope of personal role played in the mock trial more indistinct. The teaching administrating department of law school in China ' s university should pay more attentions to the simulation degree of mock trial teaching, and should establish clear standards to check the simulation degree, in the mean time, should break up the traditional organization method of classmates from the same class that gets the group of mock trial, to reduce the degree of performance and enhance the degree of simulation in mock trial teaching.
