Abstract:In digital economy times, killer acquisitions have gradually become an important way for large digital platforms to maintain their market power, and this kind of disorderly capital expansion has attracted close attentions from many countries. Killer acquisitions will eliminate potential competitive threats, undermine the future competitiveness of the market, and eventually form an oligopoly market development pattern. However, China''s current anti-monopoly system framework has certain limitations in regulating such acts, making many killer acquisitions with anti-competitive effects free from the anti-monopoly review system. In this regard, based on China''s policy considerations and practical experience, it is necessary to improve China''s M&A filing mechanism and competition damage analysis tools, and identify stifling M&A behavior in a timely manner; at the same time, it is necessary to develop post-merger investigation rules to provide a fair and orderly business environment for the development of the platform economy, so as to stimulate the vitality of the platform economy development and achieve the anti-monopoly regulatory purpose of maintaining orderly market competition.
