Abstract:Face recognition technology can serve the purpose of identification by extracting and classifying face images, which has the characteristics of automatic recognition, naturalness and complexity in risk prevention and control. This technology can be applied to many occasions. According to different purposes of application, it can be divided into the application for public welfare purpose and the application for private interest purpose. The application of face recognition technology bears the risks of infringing personal privacy, derogating personal dignity and infringing personal property rights and interests which haven′t been effectively subjected to laws and regulations. The enactment of the Personal Information Protection Law is a good opportunity for better regulating the application of face recognition technology. In the future, based on the legal framework provided by the Personal Information Protection Law, we can gradually draw up the norms applicable to face recognition technology, clarify the legal principles of face recognition technology and the obligations of users, and shift to different legal focuses under different application scenarios.
