    摘要:

    十八届四中全会提出要加快建立符合职业特点的法治工作人员管理制度,作为法官管理制度的重要内容,我国现行法官 惩戒机制存在着主体中立性不足、程序设计对法官权益保障不充分、公正性不强等问题,严重制约着我国法官职业保障水平和 法官队伍职业化建设,亟待改革、完善。改革我国法官惩戒机制,应该在有效监督法官不当行为的前提下加强法官职务保障和 有利于法官公正独立行使审判权,具体而言,需要设立中立性和专业性的惩戒主体,实现惩戒程序对程序公正的追求,并完善 救济渠道

    Abstract:

    As the important content of judge's management system , China's current judge disciplinary system and program has problems of insufficient neutrality, being inadequate to protect the rights of the judge as well as unreasonable procedure, which seriously restricts the Chinese justice occupation guarantee level and judges professional construction, and needs urgent renovation and perfection. To reform judge disciplinary mechanism and procedure, a stronger occupation guarantee system is needed under the premise of effective supervision of the judge. In particular, a more neutral and professional disciplinary body is needed, more rights of procedure should be realized in judge disciplinary system, and the relief channel and mechanism should be improved
