    摘要:

    广告代言人因违法代言行为造成消费者利益损害的①,是否应该承担赔偿责任,《广告法》并未规定,广告代言人因此而逍遥法外。这对于消费者而言,显属不公平。根据公平及权利义务对等原则,广告代言人应对其违法行为承担相应民事责任。

    Abstract:

    It is not required in Advertising Law that whether advertising spokespersons should take compensation responsibilities for their illegal endorsement activities which damage consumers' benefits.Consequently,advertising spokespersons always remain free from legal punishment,which is evidently unfair for consumers.According to the principle of fairness and equal rights and obligations,advertising spokespersons should take the corresponding civil responsibilities for their illegal endorsement.
