Abstract:Rural collective public welfare construction land has an irreplaceable role in the improvement of rural public facilities and the improvement of farmers'' living standards, but the current norms have few provisions on it, resulting in the dilemma of ambiguous application, the reason for this is fundamentally due to the unclear structure and unclear value of collective public welfare construction land itself. It should be clarified that the rural collective public welfare construction land should be centered on safeguarding the interests of collective members, focusing on the optimal utilization of land resources, and the balance between public and private forces should be implied in the specific setting. It can be concluded that the main body of the right to use the land for public welfare construction of rural collectives is actually a pluralistic mixed subject with the farmer collective as the core, and due to its own public welfare attributes, some of the powers are limited, and its circulation should be restricted by the fit for purpose and planning.
